Terms of Service

These Terms of Service ("Terms") govern your use of the DekAI platform operated by DekAI ("Company," "we," "us"). By accessing or using our Service, you agree to these Terms.

1. Service Description

DekAI provides AI visibility intelligence — we monitor how AI assistants (ChatGPT, Claude, Gemini, Perplexity) mention your business and provide reports, scores, and recommendations to help improve your AI presence.

2. Account Registration

  • You must provide accurate business information.
  • You are responsible for maintaining the security of your account.
  • One organization account per business entity.
  • You must be at least 18 years old and authorized to act on behalf of the business.

3. Subscription & Billing

  • Free audits are provided at no cost with limited features.
  • Paid plans (Essentials, Professional) are billed monthly via Stripe.
  • You may cancel at any time through your Stripe Customer Portal.
  • Refunds are handled on a case-by-case basis within 14 days of charge.

3.1 EU Business Users — Exit Right

If you are a business user in the European Union, you may terminate your subscription with 2 months' notice, in accordance with the EU Platform-to-Business Regulation. Contact support@dekai.ai to exercise this right.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or automate access to the platform
  • Misrepresent your business identity to manipulate AI visibility scores
  • Use the Service to harass, defame, or interfere with competitors
  • Share account credentials with unauthorized parties
  • Exceed reasonable API usage limits (if applicable)

5. AI-Generated Content Disclaimer

Our reports contain AI-generated analysis and recommendations. These are produced using large language models and automated scoring algorithms. They are provided for informational purposes only and do not constitute professional advice (legal, marketing, or otherwise).

You should review all recommendations with a qualified professional before implementation. We do not guarantee that implementing our recommendations will result in any specific outcome, including improved AI visibility scores.

6. Google Analytics & Search Console Integration

DekAI offers optional integration with your Google Analytics (GA4) and Google Search Console accounts. By connecting these services, you:

  • Authorize DekAI to access your analytics data in read-only mode via Google OAuth 2.0
  • Acknowledge that DekAI will sync aggregated metrics daily to provide AI influence modeling, visitor quality analysis, and traffic diagnostics
  • Confirm that you have the authority to grant access to the connected Google properties
  • Understand that you can revoke access at any time from your DekAI dashboard or from your Google Account permissions

Our use of Google API data complies with the Google API Services User Data Policy, including the Limited Use requirements.

6.1 Data Accuracy

AI influence estimates, visitor quality comparisons, and funnel metrics derived from your GA4 data are statistical models, not exact measurements. They depend on the accuracy and completeness of your Google Analytics configuration (including key event setup). DekAI does not guarantee the accuracy of metrics derived from third-party data sources.

7. Intellectual Property

  • The DekAI platform, branding, and methodology are our intellectual property.
  • Reports generated for your business are licensed to you for internal use.
  • You retain ownership of your business information.
  • Aggregate, anonymized data may be used to improve the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEKAI'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR LOSS OF DATA.

AI-generated recommendations are provided "as is." We do not warrant the accuracy, completeness, or fitness for any particular purpose of AI-generated content in our reports.

9. Termination

  • You may terminate your account at any time via account settings.
  • We may terminate accounts that violate these Terms with 30 days' notice (or immediately for severe violations).
  • Upon termination, we will retain your data for a 30-day grace period, then permanently delete it.
  • You may export your data before or during the grace period.

10. Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved through binding arbitration in Ontario, Canada, except where prohibited by local law. For EEA-based users, mandatory consumer protection laws of your country of residence shall apply, and disputes may be brought before the courts of your country of residence in accordance with applicable law.

11. Changes to These Terms

We will notify registered users by email at least 30 days before any material changes to these Terms. Continued use after changes take effect constitutes acceptance.
